Before using www.fantasyshopper.com (the “Service”), we recommend and ask that you read the following documents as they form the basis of how you can use the Service:

All of our terms are very important, and we suggest that you (and, if are aged 17 or under, you and your parent/guardian) read all of the documents listed above.

The relationship between Fantasy Shopper and You

This document, together with any document referred to within it, sets out the terms of your relationship with Fantasy Shopper Limited (“Fantasy Shopper”, “we”, “us” or “our”) and how you can use the Service.

If you are aged 13 to 17 years old, you must ask your parent/guardian to read and agree to these terms. If you use the Service and you are aged 13 to 17, you are agreeing that your parent/guardian has said that it is ok for you to use the Service and that they have read and agreed to these terms.

By setting up an account with us, or using or accessing the Service, you are agreeing to these Terms of Use and the collection of your information as set out in the Privacy Policy. These documents and the documents referred to in the following text, together form the entire agreement between you and us.

Your right to use the Service

You must use the Service as set out in these Terms of Use. As long as you do this then we are pleased to give you permission to use the Service. Please note that, if you fail to do this, then we may take the actions set out in the “Ending our relationship” section.

Your right to use the Service is personal to you and you are not allowed to give this right to another person or to sell, gift or transfer your account to another person. You may imprint, copy, download or temporarily store extracts from the Service onto your computer or other device for the purpose of using the Service. Your right to use the Service does not stop us from giving other people the right to use the Service.

You cannot use the Service for purposes that are commercial or business related as the Service is for your private, personal use only.

In legal terms the paragraphs above mean that we give you a personal, worldwide, royalty-free, non-assignable and non-exclusive licence to use the Service. This licence is for the sole purpose of enabling you to use and enjoy the benefits of the Service in a manner permitted by these Terms of Use.

Service Accounts

You must keep your account password private and safe. Do not share this information with anyone else or let them use your account. If you think someone else is using your account, change the password straight away and let us know.

As the account holder you are responsible for anything that happens through your account where you are at fault for the unauthorised access.

We may delete your account if it has been inactive for 6 months or for the reasons set out in the “Ending our relationship” section.

Suspicious Activity

Occasionally we may investigate and take action on accounts that are suspected of breaking the Service Rules.

Below are examples of some activities which we may regard as suspicious and may investigate:

We may suspend accounts that we suspect are breaking the Service Rules. We may also remove entries to events (including ones that have real world prizes), take the actions set out in the “Ending our relationship” section or enforce any of our other rights under these Terms of Use.

Account Usernames

We reserve the right to reclaim account usernames at our sole discretion and without notice, including but not limited to on behalf of businesses or individuals that hold legal claim or trademark on those user names. Accounts using business names and/or logos to mislead others will be permanently suspended.

Our content and the content of others

The Service belongs to us, and we own or are allowed to use all pages, screens, information and other material on or in the Service unless otherwise stated.

In legal terms, this means that we are the owner or the licensee of all intellectual property in the Service. The Service is protected by copyright law and treaties around the world. All such rights, title and interests in the Service are our exclusive property or that of our licensors. Other than as allowed in these Terms of Use you are not given a right to use the Fantasy Shopper name, or any of the Fantasy Shopper trademarks, logos, domain names and other distinctive brand features.

The service provides retailer and retailer product information within the context of an internet social game. In the interests of the game experience and maintaining ease of use, from time to time retailers and their products may be reclassified or geographically relocated to a minor degree. Such details should be considered as illustrative or notionally representative rather than real or actual and in no way imply, modify or reduce the standing or other status of the retailers or associated parties. Similarly, whilst Fantasy Shopper attempts to provide timely updates, the prices presented by Fantasy Shopper are indicative only and in no way have any bearing on the price the retailer or reseller may charge either through the game, their internet site(s) or on the high street in a real life purchase scenario.

Your Content

You confirm that images, sounds, text or information that you submit or create (“User Content”) whilst using the Service will meet the Service Rules.

You give us unlimited permission to use your User Content and provide and allow others to do the same for no fee. In legal terms this means that you grant us a worldwide, non-exclusive, royalty-free and perpetual licence to use, copy, reproduce, distribute, adapt, re-format, modify, publish, translate, licence, sub-licence, assign, transfer and sell the User Content anywhere and in any form.

ny User Content removed by you or us may continue to be stored by us in accordance with these Terms of Use. You give up any moral rights that you might have in the User Content. Our right to use your User Content does not in any way affect your privacy rights and we will always use information that indentifies you as set out in our Privacy Policy.

We do not check or moderate any User Content before it is added to the Service by users. We may later check, moderate, reject, refuse or delete any User Content if anybody objects to it, or we think that it is connected to suspicious activity or breaks one or all of the Service Rules.

Fees

The Service is free to use but you can add additional features and content using Facebook Credits. We will never take Facebook Credits from you without your permission. You can find out more about Facebook Credits from https://www.facebook.com/credits/. Using Facebook Credits means that we will not hold or have access to your bank or credit card details.

You will be responsible for any fees that you incur by accessing and using the Service such as Internet fees, or mobile phone data charges. If you are unsure whether you will incur fees, we suggest that you save this document to your favourites, log off the Internet and speak with your Internet/mobile provider or if you are 17 years old or under, a parent/guardian.

Ending our relationship

If at any time you do not feel that you can agree to these Terms of Use, the Privacy Policy or any changes made to those documents or the Service, you must immediately stop using the Service.

If you wish to end your use of the Service, please follow these instructions for deactivating your account.

We may immediately end your use of the Service if you break the Service Rules, any other important rule(s), or terms and conditions we set for accessing and using the Service including these Terms of Use.

If we end your use of the Service for breaking any of the Service Rules, any other important rule(s) or terms and conditions, you may not use the Service again and we may delete or modify your User Content, account or any other information we hold about you. You will lose any benefits, privileges, or items obtained or purchased through your use of the Service. We will not offer you compensation for any losses.

We may also withdraw the Service as long as we give you reasonable notice that we plan to do this so that you have a reasonable period of time to download any of your User Content.

Advertisements on the Service

Fantasy Shopper and its selected business partners may provide advertising to you through the Service or by email. This advertising may be based on your User Content or other information available through the Service and will be displayed on the Service.

Our liability/responsibility to you

This section sets out our entire responsibility to you under these Terms of Use and unfortunately means that in places, we have had to use some legal words and phrases. Although we have written this section as plainly as possible, we strongly suggest that if you are aged 13-17, you get your parent/guardian to read this.

Unfortunately, due to the nature of the Internet and technology, the Service is provided on an “as available” and “as is” basis. This is because we are unable to promise that your use of the Service will be uninterrupted, without delays, error-free or meet your expectations. Likewise, we cannot promise the accuracy, currency, availability, correctness and completeness of the information contained on the Service (although we will make reasonable efforts to achieve this).

To the extent permitted by the law our total responsibility for any claims under these Terms of Use or related to the use of the Service is limited to the amount you have paid us or £100 (whichever is the lower). In every case, we will never be responsible for any loss or damage that is not reasonably foreseeable.

We display prices for clothing and clothing accessories on the Service for information only. Sellers of clothing and clothing accessories may change the price of an item at any time. We are not involved in selling clothing and clothing accessories and take no responsibility for any purchase you make after seeing such items on the Service.

Resolving disputes

If you have a dispute with Fantasy Shopper, in the first instance please contact us here and attempt to resolve the dispute with us informally.

In the unlikely event that we are not able to resolve the dispute informally, we will discuss and agree with you the most effective way of resolving the dispute using mediation or arbitration based on the nature of our dispute.

Changes to the Service

We are constantly updating and improving the Service to try and find ways to provide you with new and innovative features, games and services. Improvements and updates are also made to reflect changing technologies, tastes, behaviours and the way people use the Internet and our Service. In order to do this, we may need to update, reset, stop offering and/or supporting a particular part of the Service, feature or game relating to the Service (“changes to the Service”). These changes to the Service may affect your progress in the game, your awards, your achievements and your User Content (“game elements”). Any changes to the Service could involve your game elements being deleted or reset.

You agree that a key characteristic of our Service is that changes to the Service will take place over time and this is an important basis on which we grant you access to the Service. Once we have made changes to the Service, your continued use of the Service will show that you have accepted any changes to the Service. You are always free to stop using the Service or deactivate your account

We will try, where possible and reasonable, to contact you to let you know about any significant changes to the Service.

Changes to the documents

We may revise these Terms of Use from time to time but the current version will always be at http://www.fantasyshopper.com/about/terms/.

Changes will usually occur because of new features added to the Service, changes in the law or where we need to clarify our position on something.

We will try, where possible and reasonable, to contact you to let you know about any significant changes to any of the documents referred to in these Terms of Use. We may contact you through the Service (for example by asking you to accept the changes before you continue to use the Service) or via a separate email.

Normally, we will try to give you some warning before the new terms become effective. However, sometimes changes will need to be made immediately and if this happens we will not give you any notice.

The current version of the Terms of Use contains the only terms and conditions that apply to our relationship with you. Older versions of the Terms of Use will no longer apply to our relationship and will be completely replaced by the current version.

We intend to rely on these Terms of Use as setting out the written terms of our agreement with you for the provision of the Service. If part of the Terms of Use cannot be enforced then the remainder of the Terms of Use will still apply to our relationship.

If you do not comply with these Terms of Use and we do not take action immediately, this does not mean we have given up any right we have and we may still take action in the future.

Law

As we are based in England, English law will apply to all disputes and the interpretation of these Terms of Use. The English courts will have non-exclusive jurisdiction over any dispute arising from or related to your use of the Service.
